The Problem

AI agents are becoming operational infrastructure for businesses. They handle customer support, process claims, generate code, manage supply chains. But when an AI agent makes a mistake — gives wrong medical advice, leaks customer data, makes a discriminatory hiring decision — who pays?

Until recently, businesses assumed their existing insurance covered AI errors. They were wrong. Starting January 1, 2026, the Insurance Services Office (ISO) introduced endorsements (CG 40 47 and CG 40 48) that broadly exclude generative AI outputs from Commercial General Liability policies. This means:

  • If your AI chatbot defames someone → not covered
  • If your AI agent leaks proprietary data → not covered
  • If your AI makes a decision that causes financial loss → not covered

Businesses are waking up to a massive, uninsured risk. The specialized AI insurance market barely exists, it's fragmented, and most companies don't even know their existing policies have new exclusions.
