The Problem

EU Directive 2023/2673 introduces a mandatory "withdrawal button" for ALL distance contracts concluded via online interfaces (websites and apps). By June 19, 2026, every online store, SaaS platform, and digital service provider in the EU must provide consumers with a prominently placed, easily accessible button labeled "Withdraw from contract" (or equivalent) that allows one-click withdrawal within the 14-day cooling-off period.

This is NOT the same as the existing subscription "cancel button" (covered by DesistirJá in this index). The withdrawal button applies to:

  • One-time purchases (goods, services)
  • Financial services contracts
  • Any distance contract concluded online

Key requirements:

  • No login/authentication required to access the button
  • Must capture consumer name, contract identification, and contact info
  • Must generate an acknowledgement of receipt
  • Must be continuously available throughout the entire withdrawal period
  • Must be clearly distinguished from the subscription cancellation button

Penalties for non-compliance: Withdrawal period extends from 14 days to 12 months + 14 days (yes, really). Plus fines up to €50,000 or 4% of annual turnover. Plus competitor/consumer association injunctions.
